Amazon allows big dog retailers to break rules, hurt small 3P sellers

Not all players on the Amazon platform are treated equally. And the larger the company, the more likely Amazon will allow them to break the rules and hurt small sellers.

For a while now, manufacturers, retailers and large distributors – as well as rogue third-party sellers – have abused Amazon’s rules to get listings and other third-party sellers suspended. If a manufacturer doesn’t want a 3P seller to list their product, they will file a false claim for intellectual property infringement, trademark infringement or copyright infringement.

What makes these claims false? The third-party sellers listing the product are simply not breaking any rules. And the claimant knows it – they are simply using an unethical workaround to try and get Amazon to enforce distribution or MAP pricing. And everyone knows it – including Amazon.

When a third-party seller receives this kind of complaint, Amazon tells them to work it out with the IP holder. In most cases, though, the IP holder refuses to respond.

If the third-party seller appeals to Amazon about the lack of communication, Amazon typically removes the black mark from the seller’s account. But if the complaining party is a large retailer or manufacturer – even if they are lying! – Amazon simply won’t help.

Disgraceful.

We are one week into 2018. Do you know where your business plan is?

A simplified SMART plan can help your business in 2018. A traditional plan may be just too daunting for most Amazon and online sellers. And let’s face it – a lot of business plan formats are just…long. They are lengthy, detailed and full of information that’s not necessary unless you are applying for a business loan or trying to entice a suitor.

So if you’re an entrepreneur more focused on hustle than documentation, how about creating a quick bullet-point business plan based on SMART goals for 2018?

Just make sure your goals are:

  1. Specific (simple, sensible, significant)
  2. Measurable (meaningful, motivating)
  3. Achievable (agreed, attainable)
  4. Relevant (reasonable, realistic and resources, results-based)
  5. Time bound (time-based, time-limited, timely, time-sensitive)

Don’t worry, it won’t take long. Just a few bullet points on a page can give you new focus for success this year.

But here’s the most important part. Make an appointment with yourself for the first day of the month, every month for the rest of the year. Write it in your appointment book or set an alarm on your phone today! That way, you’ll review those goals and make sure you stay on track.

Restricted products, don’t let them blow up your Amazon account.

When you’re a third-party Amazon seller, it’s easy to make poor assumptions on restricted products.

For example, you might assume that you can sell anything that you can find on Amazon.com. Or, you might assume that you can sell all legal products. However, there are restricted products you need to be aware of.

Both of these assumptions would be quite false:

  • Don’t fall into the trap of uploading large catalogs for drop-shipping. These might include prohibited – or even illegal – items for sale.
  • Just because it’s legal, doesn’t make it ok. For example, vaping accessories cannot be sold on Amazon. Nor can many supplements – even some you might find at the local drug store.
  • Amazon reserves some dangerous items for itself. Amazon.com retail sells tasers, but it doesn’t allow its third-party sellers to list them.
